Rep. Tony Kurtz addresses DATCP rule changes affecting animal industry fees

Rep. Tony Kurtz, a Republican representing Wisconsin's 41st House district since his election in 2025, recently posted a series of statements on social media regarding proposed regulatory changes by the Wisconsin Department of Agriculture, Trade and Consumer Protection (DATCP).

On September 16, 2025, Kurtz wrote: "1/5 The Wisconsin Dept. of Agriculture, Trade and Consumer Protection (DATCP) has proposed significant changes to rules, ATCP 10 and 12, regulating Animal Disease and Movement and Animal Markets, Dealers and Truckers."

He continued in another post on the same day: "2/5 These changes include massive fee increases, some nearly 1700% above current rates. This is not a legislative initiative, and unfortunately because of the recent court cases, the legislature likely has very few options for intervention."

Kurtz also highlighted resources available to those interested in the rule changes: "4/5 The Wisconsin Farm Bureau has put together a great page of information on the rule changes, where to comment and examples of testimony. Comments are due by October 15th."

The DATCP’s proposed amendments to ATCP 10 and 12 address regulations governing animal disease control as well as oversight of animal markets, dealers, and truckers. According to Kurtz’s posts, these proposals would result in substantial fee increases for affected stakeholders—some fees rising by up to 1700%. He noted that due to recent court decisions limiting legislative authority over such agency actions, lawmakers have limited capacity to intervene.

Kurtz succeeded Alex Dallman as representative for Wisconsin’s 41st House district following his election in 2025.
